Display Company (the "Company") warrants to the original purchaser that any
Featherlite product manufactured by the Company shall be free from defects in material and
workmanship under normal use and service for a period of five years after the date of
shipment. The obligation of the Company under this warranty is limited to repairing or
replacing, as the Company may elect, free of charge, any part that proves, in the
Company's judgement, to be defective in material or workmanship. To qualify for warranty
service, the original purchaser must return the product to the Company at the above
address along with the original warranty certificate. All shipping and transportation
costs shall be borne by the original purchaser.
IT IS EXPRESSLY
AGREED BETWEEN THE ORIGINAL PURCHASER AND THE COMPANY THAT THE REMEDY OF REPAIR OR
REPLACEMENT IS THE EXCLUSIVE AND SOLE REMEDY OF THE ORIGINAL PURCHASER.
This warranty and
the Company's obligation thereunder is in lieu of, and the Company disclaims, all other
warranties, expressed or implied, including without limitation, the implied warranties of
merchantability and fitness for a particular purpose, all other representations to the
original purchaser and all other obligations and liabilities.
In no event shall
the Company bear any liability to the original purchaser or any third party for damage,
howsoever caused, to person or property, or for loss of anticipated profits or for any
other direct, indirect, incidental or consequential damages suffered by the original
purchaser or any other person, whether as a result of or in connection with or as an
incident to the design, manufacture, installation, repair, replacement, use or operation
of the product or components thereof or otherwise.
All claims for
damage or loss incurred to product in transit must be made directly to the carrier.
Returns will not be accepted unless made in accordance with written acceptance and
shipping instructions of the Company. The Company will not be responsible for damages,
delays, or charges caused by/or as a result of strikes, accidents, events or acts of God
beyond its control. |
